Fox Sports' Use of Arcade Fire Tunes Legal, Yet Sleazy

arcade fire.jpg copy 4Yesterday we reported that the Arcade Fire's camp may seek legal recourse for the unauthorized use of their music in "bumps" between breaks during this past Super Bowl broadcast. Upon further research, the FCC strikes again: Fox Sports' actions were totally legit under the 1972 Copyright Act, which states that "ephemeral use" (as in, only once) during a live broadcast is kosher as can be.

The Daily Swarm cited a very similar situation that involved Minor Threat's music being used in a similar manner. Another pack of crazy kids messing with Ian MacKaye. Someone's got a death wish. Anyway, the Arcade Fire's Win Butler won't be seen in court anytime soon, and while the whole deal smacks of sketch, I would just like to point out that I watched the Super Bowl in a roomful of sideswept bangs and skinny jeans in Brooklyn. No one is safe from the joy of organized sports (and beer).
